Scott Mackintosh and Rhineland Construction Ltd. was contracted to do renovations on our home, gave us a rough estimate of $90,000.00 and asked for 50% as deposit plus GST. Agreements pursuant to the contract were made with us by Scott Mackintosh that were not complied with by him or Rhineland Construction Ltd. Scott Mackintosh was7 away more than he was on our job: he took 9 days off at the start of our renovations for his personal move, then left the Province for 2 weeks to visit family (telling us he would only be away for 4 days), ended up being away for over 3 weeks of the 6 weeks the contract remained in affect.
Scott Mackintosh brought in trades, but directed us to work directly with them and pay them directly, instead of paying them with the deposit we gave him (only paying 3 trades from our deposit). Scott Mackintosh also instructed us to hire trades to do work that was in our contract for him to do, and never provided us with an updated budget (contract required it to be provided on our start date). Scott Mackintosh kept assuring us we were within our budget as we went along taking off and adding thingsto the list, ultimately going over the budget by over $20,000.00.
Scott Mackintosh also mislead us, for example, in advising us why he could not comply with agreed upon start dates for our renovation, telling us that it would take several months to receive BC1 paperwork because of Covid 19, when it only took 3 days for another excavator to get one for us: we subsequently learned that his excavator was on another job and THAT was the real reason for the delays. When we confronted Scott Mackintosh that his misleading statements were "lies", he replied "You're confusing lying with protecting your best interests".
Scott Mackintosh left his 'personal time' blank on the final budget (when he was asking for even more money). We fired Scott Mackintosh and Rhineland Construction Ltd. at the 6 week mark, and he kept the balance of our deposit (and our house key). After we terminated Scott Mackintosh, he sent me a text telling me that I am not allowed to use "his trades" and to find my own.
Scott Mackintosh and Rhineland Construction Ltd. then sued us in the Small Claims Court for monies allegedly lost by them because we continued to complete renovations after we fired him and Rhineland Construction Ltd., even though the contract they drafted stated that we can hire subtrades: the contract also stated it could be terminated prior to the completion of services upon 7 days' written notice: it did not however, require any reason for its cancelation, although we believed we had many valid reasons for doing so.
Small Claims Court was a "draw", all of us walking away since it would have cost us more than the amount we were trying to recoup.
We also note that two of the reviews for Scott Mackintosh and Rhineland Construction Ltd. are made by people with the same surname as Scott Mackintosh.
We are writing our review of Scott Mackintosh and Rhineland Construction Ltd. simply to advise others of some of the issues that arose in our contractual relationship with them with respect to the renovations to our house.
